Thank you for inviting me to testify about the constitutionality of the proposed amendments to the Indian Health Care Improvement Act (the IHCIA; as amended, the Act).1 In particular, I have been asked to address: (1) whether Congress has the constitutional authority to amend the Act to provide benefits and services to Indians2 and Urban Indians
