Abstract:
This Division provides no Indian- or tribal-specific provisions or protections. However, Indian people would enjoy the same benefits - or suffer the same penalties (e.g., tax penalties) that apply to the general population, with no recognition of the US trust responsibility for Indian health. In addition, there is no language to guarantee that Indian health care providers would be assured admission to provider networks. In fact, the licensing provision included in this Division would actually exclude Indian health care providers from participation in public plan. The omission of specific Indian language in this Division prompted the development of Rahall amendment package.
